Important Notice
Service Description
AccessHawk is an AI-powered web accessibility scanning tool that analyzes websites for potential WCAG (Web Content Accessibility Guidelines) compliance issues. The Service:
- Captures screenshots, accessibility trees, and HTML structure from URLs you submit
- Sends captured data to AI language models via OpenRouter for analysis
- Returns AI-generated reports identifying potential accessibility issues
- Stores scan results securely in your account with encryption at rest
The Service is NOT:
- A legal compliance certification service
- A replacement for professional accessibility audits
- A guarantee of WCAG, ADA, Section 508, or any other compliance
- A substitute for manual accessibility testing and expert review
AI Technology Disclaimer
AccessHawk uses artificial intelligence (AI) language models to analyze websites. You acknowledge and agree that:
You must not rely solely on AccessHawk's AI-generated reports for compliance decisions, legal defense, or accessibility certifications.
User Responsibilities
By using the Service, you represent, warrant, and agree that:
URL Authorization
- You have proper authorization to scan any URL you submit to the Service
- You own, control, or have explicit permission from the owner of the websites you scan
- Your use of the Service to scan URLs complies with all applicable laws and the terms of service of the scanned websites
- You will not scan URLs for the purpose of identifying vulnerabilities in websites you do not own or have permission to test
Acceptable Use
You agree NOT to use the Service to:
- Scan websites for malicious purposes, including but not limited to reconnaissance for attacks
- Attempt to circumvent, disable, or interfere with security features of the Service
- Overload, flood, or spam the Service with excessive requests
- Use automated tools to access the Service beyond normal browser usage
- Resell, redistribute, or commercially exploit the Service without authorization
- Scan websites containing illegal content
- Violate any applicable law, regulation, or third-party rights
Compliance Responsibility
You acknowledge that accessibility compliance remains your sole responsibility. The Service is a supplementary tool to assist in identifying potential issues. It does not replace the need for:
- Professional accessibility audits by qualified experts
- Manual testing with assistive technologies
- User testing with people with disabilities
- Legal counsel regarding compliance requirements
Subscription Plans & API Keys
Merchant of Record
Polar Software, Inc. acts as the Merchant of Record for all AccessHawk subscriptions and purchases. This means:
- Invoices and receipts will be issued by "Polar Software, Inc."
- Credit card statements will show charges from Polar
- Polar handles international sales tax collection and compliance
- Your billing information is processed according to Polar's Privacy Policy and Terms of Service
Included Scans
Each subscription tier includes a monthly allocation of scans. These scans use AccessHawk's service API key—no personal API key is required. LLM costs for included scans are covered by your subscription.
BYOK Overflow (Paid Tiers Only)
Paid subscribers may optionally configure their own OpenRouter API key to continue scanning after exhausting their monthly allocation ("BYOK Overflow"). By providing your API key, you:
- Acknowledge that your key will be encrypted with AES-256-GCM and stored in your account
- Understand that your key will only be decrypted momentarily when making API requests on your behalf
- Understand that API usage charges for overflow scans will be billed directly to your OpenRouter account
- Accept responsibility for setting appropriate spending limits on your OpenRouter API key
- Agree to OpenRouter's Terms of Service
Third-Party AI Services
All scans (whether using included allocations or BYOK Overflow) are processed through OpenRouter, which routes requests to various AI providers (OpenAI, Anthropic, Google, etc.). You acknowledge that your scan data will be processed according to OpenRouter's and the respective AI provider's terms of service and privacy policies.
OAuth Authentication
AccessHawk offers optional sign-up and login via Google, GitHub, and Microsoft OAuth. By using OAuth authentication, you:
- Authorize AccessHawk to receive your name and email address from the OAuth provider—no additional permissions are requested
- Acknowledge that you can link or unlink OAuth providers from your account at any time via Account Settings
- Agree to the respective OAuth provider's terms of service: Google Terms, GitHub Terms, and Microsoft Terms
API Usage
AccessHawk provides a REST API for programmatic access to accessibility scanning. By using the API, you acknowledge and agree to the following terms in addition to all other provisions of this agreement:
Access & Eligibility
- API access is available exclusively to users on paid subscription tiers (Hobby, Pro, or Team). Free-tier users do not have API access.
- API access is granted upon subscription and may be revoked if you downgrade to a free tier or if your subscription lapses.
Rate Limits & Usage
- API requests are subject to rate limits, which may vary by subscription tier. Current rate limits are documented in the API documentation available after sign-up.
- AccessHawk reserves the right to modify rate limits at any time. We will make reasonable efforts to notify users of significant changes.
- API scans count against your monthly scan allocation, the same as scans initiated through the web interface.
API Key Security
Your API keys are confidential credentials.
- You are solely responsible for maintaining the confidentiality and security of your API keys
- Do not share, publish, or embed API keys in client-side code or public repositories
- You are responsible for all activity that occurs under your API keys
- Notify AccessHawk immediately if you suspect unauthorized use of your API keys
Acceptable Use
- Automated scanning via the API must comply with the same acceptable use policies as manual scans, including URL authorization requirements described in Section 03.
- Webhook URLs configured to receive scan notifications must be endpoints you own or control.
- You may not resell, sublicense, or provide API access to third parties without prior written authorization from AccessHawk.
Enforcement & Revocation
- AccessHawk reserves the right to revoke API keys immediately and without notice for abuse, violations of these Terms, or activity that threatens the stability or security of the Service.
- Excessive requests, automated abuse, or circumvention of rate limits may result in temporary or permanent suspension of API access.
Availability & Data
- API availability is provided on a best-effort basis. AccessHawk does not guarantee any specific uptime or service-level agreement for API access.
- Data returned via the API is subject to the same data policies, limitations, and disclaimers as data accessed through the web interface, including the AI Technology Disclaimer in Section 02.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
ACCESSHAWK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Legal actions, lawsuits, fines, or penalties arising from accessibility non-compliance
- Loss of business, revenue, profits, or anticipated savings
- Damages arising from reliance on AI-generated analysis or recommendations
- Damages arising from errors, omissions, or inaccuracies in scan reports
- Damages arising from unauthorized access to or alteration of your transmissions or data
- Any third-party claims against you
IN NO EVENT SHALL ACCESSHAWK'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
Indemnification
You agree to indemnify, defend, and hold harmless AccessHawk and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- URLs you submit to the Service that you were not authorized to scan
- Any claims related to accessibility compliance or non-compliance of your websites
- Your reliance on or implementation of recommendations from the Service
Intellectual Property
Service IP: The AccessHawk name, logo, website design, code, features, and functionality are owned by JonesLabs LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without prior written consent.
Your Content: You retain ownership of the URLs you submit and the scan reports generated for your use. Reports are stored securely in your account and you may export or delete them at any time.
Feedback: If you provide feedback, suggestions, or ideas about the Service, you grant AccessHawk a perpetual, irrevocable, royalty-free license to use and incorporate such feedback without obligation to you.
Termination
AccessHawk reserves the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:
- Violation of these Terms of Service
- Abusive or excessive use of the Service
- Requests by law enforcement or government agencies
- Discontinuation or modification of the Service
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to limitation of liability and indemnification.
Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Georgia, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Atlanta, Georgia, and the language of arbitration shall be English.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
Changes to Terms
AccessHawk reserves the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
We encourage you to review these Terms periodically for any changes.
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
